Version of 1 May 2026 · Effective as of account creation

These terms of use (hereinafter the "ToU") govern access to and use of the Milodomain.com platform, published by Horizon Investissement. They are complementary to the general terms and conditions of sale, which govern the auction operations themselves. In the event of contradiction, the GTCS shall prevail over the ToU for everything concerning the auction and the allocation of a domain name.

Article 1 — Purpose

The ToU define the terms of access to the site, the creation and management of the user account, security and the conduct expected of users. Any registration constitutes unreserved acceptance of these ToU, the GTCS, the privacy policy and the legal notice.

Article 2 — Access to the platform

Access to Milodomain.com is open for free consultation for its public pages (homepage, domain catalogue, domain pages, blog, legal pages).

Access to the auction features and the personal area is reserved for registered users. Registration is free and without commitment, subject to compliance with the eligibility conditions defined below.

Article 3 — Eligibility conditions

Registration is open to:

  • natural persons of legal age within the meaning of French law (eighteen years of age) and having full legal capacity;
  • legal entities under French or foreign law, duly represented by a natural person empowered to bind them.

The user declares and warrants, at the time of registration, that they meet these conditions. Horizon Investissement reserves the right to request at any time the production of supporting documents (identity document, Kbis extract, power of attorney, etc.) and to suspend the account pending such production.

Article 4 — Account creation

The creation of the account requires the complete and accurate entry of the following information, which constitutes the user's AFNIC Contact in the event of an award:

  • first name and surname;
  • postal address (street, postcode, city, country);
  • contactable telephone number;
  • valid email address;
  • password of at least eight characters.

The user undertakes to provide truthful information and to keep it up to date from their personal area. The use of false information or borrowed identities constitutes legitimate grounds for immediate suspension or termination.

Article 5 — Acceptance of contractual documents

When creating the account, the user accepts in a single action, via a single tick box, all the contractual documents of Milodomain.com: ToU, GTCS, legal notice and privacy policy. The acceptance button is only activated after the entire displayed text has been scrolled, in order to ensure that the user has had the opportunity to review it.

The acceptance is timestamped and recorded in the registers of Horizon Investissement. The user acknowledges the value of this electronic evidence in accordance with Articles 1366 and 1367 of the French Civil Code.

In the event of a substantial modification of the contractual documents, Horizon Investissement invites the user to renew their acceptance at their next connection. Failing renewal, access to the auction features may be suspended until acceptance.

Article 6 — Security and confidentiality of credentials

The user is solely responsible for the confidentiality of their login credentials and for all actions carried out from their account. They undertake to:

  • choose a strong password distinct from those used on other services;
  • not communicate their credentials to third parties;
  • inform Horizon Investissement without delay, at [email protected], of any unauthorised use of their account or any suspected security breach.

Horizon Investissement disclaims all liability for the consequences of unauthorised use resulting from the user's negligence in safeguarding their credentials.

Article 7 — Fair use of the platform

The user undertakes to use Milodomain.com in accordance with its purpose and these ToU. They are notably prohibited from:

  • creating multiple accounts for the same natural or legal person, except with the prior written authorisation of Horizon Investissement;
  • placing bids without a real intention to acquire the domain name (sham bids, "shill bidding"), or having a tier affiliated account (trusted third party, household member, employee, agent, related company, etc.) bid for their benefit or against themselves so as to artificially influence the course of an auction;
  • organising or participating in any agreement between bidders whose object or effect is to distort the natural functioning of the auction;
  • attempting to circumvent, alter or saturate the technical systems of the platform, in particular through unauthorised automated requests, robots, injection attempts or any other offensive technique;
  • extracting all or part of the content of the site by automated means (scraping, site rippers, unauthorised indexing robots, etc.) for the purpose of constituting a competing database or for commercial exploitation;
  • publishing, via the free fields of the site, content that is unlawful, defamatory, insulting, racist, or that infringes upon the privacy or rights of third parties;
  • using the platform for purposes contrary to public order or good morals.

The use of the platform is granted to the user on a strictly personal and non-exclusive basis, for the sole purpose of taking part in the auctions and managing their account. Any commercial exploitation, redistribution or making available of the site's content to third parties is subject to the prior written authorisation of Horizon Investissement.

Article 8 — Intellectual property

All elements making up Milodomain.com (texts, illustrations, Milo mascot, photographs, trademarks, logos, graphic charter, source code, information architecture) are protected by intellectual property law and remain the exclusive property of Horizon Investissement or its partners. Use of the site grants the user a strictly personal, non-exclusive and non-transferable right to access the platform within the framework defined by these ToU. Any other exploitation is subject to prior written authorisation.

Article 9 — Availability of the service

Horizon Investissement implements reasonable means to ensure the continuous availability of Milodomain.com. However, it cannot be held to an obligation of absolute availability. Temporary interruptions may occur for reasons of maintenance, updating, computer attack, failure of a third-party provider or force majeure. Except in cases of urgency, scheduled interruptions are subject to prior notification.

Article 10 — Suspension and termination

10.1. By the user

The user may terminate their account at any time from their personal area or by sending a request to [email protected]. Termination is effective free of charge, subject to the full performance of any current obligations (active bids, unpaid awards).

10.2. By Horizon Investissement

Horizon Investissement may suspend or terminate an account as of right in the event of:

  • serious or repeated breach of the ToU or GTCS;
  • provision of inaccurate or misleading information;
  • failure to pay;
  • fraudulent behaviour, manipulation of bids, multiple or affiliated accounts as prohibited under article 7;
  • infringement of the security or proper functioning of the platform.

Suspension is notified by email. In the event of a serious breach, termination may be pronounced without notice. In other cases, a formal notice is sent beforehand, granting the user a period of 15 days to remedy the situation.

In addition to suspension or termination, Horizon Investissement may, in proportion to the seriousness of the breach observed:

  • cancel the bids in progress placed from the relevant account, as well as any provisional allocation that may have resulted, without giving rise to any indemnity;
  • refuse any future registration originating from the same natural or legal person;
  • retain, as evidence, the history of connections, bids and exchanges of the relevant account, in accordance with the retention periods set out in the privacy policy;
  • report the facts to the competent authorities (judicial police services, public prosecutor, AFNIC, regulatory authorities) in the event of conduct liable to criminal qualification, in particular fraud, fraudulent manoeuvres, infringement of an automated data processing system or identity theft.

10.3. Fate of the data

Upon termination, personal data is retained according to the rules and durations set out in the privacy policy. Previous bids and orders remain governed by the GTCS in force at their date.

Article 11 — Applicable law and jurisdiction

These ToU are governed by French law. Any dispute relating to their formation, interpretation, performance or termination shall, failing amicable resolution or mediation, fall within the exclusive jurisdiction of the Paris judicial court or the Paris court for economic activities, without prejudice to the mandatory rules of the Consumer Code applicable to the consumer.
